A Due Diligence Checklist for Land Acquisitions
The land items that belong on every closing checklist, in the order we work them.
Verify Ownership
Confirm surface and mineral ownership on every tract in the target package. Track back through the chain to identify unrecorded conveyances, defective instruments, and missing successors before the deal closes.
Identify Risk
Overlapping leases, expired instruments, unreleased mortgages, top leases, and pending litigation are the risks that most often surface too late. Flag them, price them, and negotiate them before signing.
Confirm Obligations
Every lease and agreement in the package carries obligations — continuous drilling clauses, minimum royalty, ROW payments, restoration duties. Confirm they are current and that the seller can transfer them cleanly.
